This overview is for convenience. The full policy below provides the details.
FX:Scape LLC ("FX:Scape," "we," "us," or "our") respects the privacy of individuals who visit our website, use our software tools, inquire about our services, purchase products, or interact with our business. This Privacy Policy explains the personal information we collect, the sources and purposes of that information, the circumstances in which we disclose it, retention and security practices, and how to exercise available privacy rights.
This Policy covers online and offline interactions involving FX:Scape, including our website, contact channels, customer and vendor relationships, project work, software accounts, technical calculators and digital products, unless an activity is governed by another specific notice or contractually required privacy arrangement. It does not automatically govern independently operated third-party websites or a customer's own processing activities. Where FX:Scape processes information solely on behalf of a commercial customer under a separate agreement, the customer's instructions and applicable agreement may govern that processing.
We collect information needed to communicate, provide contracted services, operate software, manage projects, process transactions, protect systems, and satisfy legal obligations. Depending on the interaction, this may include contact and business information, messages, transaction records, technical logs, and information you intentionally submit to a tool. We use third-party business technology providers, including communications, cloud storage, hosting, collaboration, security, and payment providers. We do not intend to sell contact lists or SMS consent information. Whether any advertising or analytics technology constitutes a regulated “sale” or “sharing” depends on the technology actually deployed; those practices must be identified and disclosed accurately. You may contact us to inquire about your information and exercise applicable rights. Not every right applies to every person or company.
Depending on your relationship with us, information may include: (a) identifiers and contact information, such as name, business name, email address, telephone number, mailing or billing address, account identifier, and IP address; (b) commercial information, including quotes, purchases, project and transaction history, invoices, service requests, contract records, and preferences; (c) communications and content, including messages, attachments, technical requirements, site details, feedback, and support correspondence; (d) account and authentication information, such as username, password hashes or authentication tokens, login events, roles, and preferences when an account feature is offered; (e) internet and device activity, such as browser, device, operating system, referring pages, feature usage, error and security logs, and cookie or local-storage identifiers; (f) professional information, including employer, position, business contact details, qualifications or project assignments when supplied for business purposes; and (g) payment-related information, such as transaction status, payment method type and limited billing records received from processors. We do not currently provide online payment processing. If introduced, payment-card credentials may be collected directly by a processor rather than FX:Scape.
Some client work or user uploads may incidentally contain additional personal data. Do not submit highly sensitive personal data unless it is necessary for an expressly supported service and appropriate safeguards are agreed. We do not claim to collect every listed category from every visitor.
We may obtain information directly from you; from organizations for which you work or that engage our services; from authorized representatives, clients, vendors and collaborators; automatically from your browser, device or use of our Services; from payment, identity, communications and hosting providers; and from publicly accessible business resources where relevant to a legitimate business interaction. If we receive another person's information from you, you must have the authority to provide it and should avoid unnecessary disclosure.
We use information as reasonably necessary to respond to inquiries; prepare proposals and estimates; administer contracts; deliver technical production, programming, integration, consultation, or other services; maintain project records and communications; operate software tools and user accounts; provide customer support; process orders, subscriptions, billing and refunds; detect abuse and protect security; troubleshoot errors and improve reliability; understand use of our website where permitted; provide requested notices and, where authorized, marketing; establish, exercise or defend legal rights; and comply with tax, accounting, safety, regulatory and other legal obligations. We do not use personal information for materially unrelated purposes without an appropriate notice or other legally required basis.
Our hosting infrastructure and security services may automatically process IP addresses, timestamps, request paths, page identifiers, visit duration, user-agent details, referral information, error events, approximate location inferred from network information, and evidence of suspicious traffic. Such records support operation, troubleshooting, fraud prevention, security and service integrity. Hosting and security providers may maintain their own necessary processing records under applicable agreements. We do not promise that visiting a website produces no server-side record.
Our website, applications, and tools may use essential cookies or browser storage for security, sessions, preferences, authentication, tool state, consent choices and operational functionality. Optional analytics or advertising technologies, if enabled, may collect identifiers and usage information as described at collection and in our cookie controls. Essential storage may be used without optional analytics consent where lawful. Users can generally delete or block browser storage using their browser settings, although this may affect functionality.
Basic first-party visit and security logging runs independently of optional cookie choices. It records page visits and visit duration together with information such as IP address, browser or user-agent details, and referring page for site operation, troubleshooting, and security. Optional analytics, if enabled, follows the choice you make in Cookie settings; you can change that choice in the footer. That choice does not disable basic visit/security logs, essential sessions, or browser storage used for preferences and tools.
Our current public website maintains basic first-party visit/security logs as described above. Optional analytics is separate from that logging and, if enabled, is subject to the choice made in Cookie settings. It does not currently use advertising pixels, remarketing audiences, session replay, or third-party analytics cookies. We do not currently sell personal information or share it for cross-context behavioral advertising. If we introduce analytics, advertising, or other processing that changes these practices, we will update the relevant disclosures and provide choices and opt-out signal handling where required by applicable law. This Policy does not represent that an automated opt-out signal handler is currently implemented.
Our utilities may permit you to enter dimensions, weights, equipment properties, technical configurations, project names, or other data and may produce charts, reports, files or calculations. Some tools may operate primarily in your browser, while other functions may transmit information to a server or external service. We do not represent that all calculator inputs remain exclusively on your device unless verified for each application. Browser storage, server logs, backup processes, downloaded files and optional account-sync functions may differ by tool. Do not include personally identifying, confidential, security-sensitive or regulated information in technical inputs unless necessary and supported. Where a tool can store or transmit project data, its interface or additional notice should explain that processing clearly.
Where an account, license or paid software product is offered, we may process registration, license status, authorized seats, billing details, transaction and renewal records, support history, account preferences, and authentication activity. We do not currently provide online payment processing. If payment services are introduced, providers may independently process payment credentials and fraud signals, and we may receive payment confirmation and limited billing information rather than full payment-card numbers. Subscription enrollment, renewal notices, payment authorization and cancellation procedures are governed by the applicable purchase terms and mandatory law. Cancellation of a software subscription does not necessarily require immediate deletion of legally necessary transaction, dispute or accounting records.
Professional engagements may require information about client contacts, personnel, venues, schedules, project specifications, equipment, vendors, insurance, permits, safety incidents and operational matters. We may share relevant project information with authorized employees, subcontractors, professional advisors, insurers or vendors when reasonably needed to perform the contracted work and subject to suitable safeguards or duties. Please do not include unnecessary personal or sensitive information in project documents. A separate agreement may establish specific confidentiality, data handling or recordkeeping obligations.
FX:Scape uses third-party technology and business service providers to support its operations. Depending on the services used, these may include email, business telephone and messaging services, cloud hosting and storage, document management, collaboration, customer relationship management, web hosting and content delivery, cybersecurity, payment processing, billing and accounting, customer support, analytics, and professional advisory services. These providers may process information on our behalf or, where applicable, as independent entities for payment, telecommunications, legal, or other disclosed purposes. We use contractual and operational safeguards as appropriate and required by law; the availability of a provider security feature does not mean every feature is enabled in our configuration. Provider identities, locations, and processing arrangements may change, and information may be processed outside California or the United States where lawfully permitted. We provide more specific information about recipients where applicable law requires it.
We may disclose personal information to service providers or contractors supporting the purposes stated in this Policy; to project collaborators acting under applicable contracts or instructions; to payment processors and financial institutions for transactions; to professional advisors, auditors and insurers; to public authorities where lawful disclosure is required; and to parties involved in a merger, financing, sale, reorganization or transfer of business assets, subject to applicable safeguards and notice requirements. We may also disclose information to protect rights and safety, investigate misconduct or enforce agreements where legally permissible.
FX:Scape does not sell, rent, or share SMS opt-in data, mobile messaging consent, or consent status with third parties or affiliates for their own marketing or promotional purposes. This restriction applies notwithstanding the other disclosure categories in this Policy. Telecommunications carriers, messaging platforms, and service providers may process mobile numbers, consent records, and message content as necessary to transmit or administer FX:Scape communications, prevent abuse, support compliance, or meet legal requirements. This does not prohibit legally required disclosures or narrowly necessary operational processing.
FX:Scape may communicate with customers, prospective customers, vendors, and project contacts by telephone, SMS, MMS, or other business messaging channels for inquiries, quotations, appointments, project coordination, service updates, customer support, and other relevant business purposes. Some messages may be conversational, while others may be sent using a business messaging platform or a registered application-to-person messaging program. We obtain and document consent when required by applicable law and messaging-provider rules, and the scope of any consent must match the type of messages sent. An inquiry or existing business relationship does not automatically constitute consent to unrelated promotional or automated messages. If we introduce promotional text messaging, the applicable enrollment process will disclose the sender, message purpose, expected frequency or that frequency varies, message and data rate information, opt-out instructions, and access to relevant terms and privacy disclosures. Consent to marketing texts is not a condition of purchase. For messaging programs that support standard keywords, recipients may reply STOP to opt out and HELP to request assistance; for ordinary person-to-person business conversations or systems without those functions, recipients may ask us directly to stop messaging or contact us through our published channels. We will honor legally effective revocations of consent, including reasonable requests expressed in ordinary language, and maintain limited consent, opt-out, or suppression records as reasonably necessary for compliance and to avoid further unwanted messages. Message and data rates may apply depending on the recipient's carrier and plan. Message frequency varies according to the business relationship and any particular messaging program. We do not sell, rent, or share mobile messaging opt-in information or consent status with third parties or affiliates for their own marketing purposes; carriers and service providers may process information only as needed for service delivery, administration, security, compliance, or lawful disclosures. For each messaging program, its enrollment notice and available opt-out or assistance methods describe that program’s operation. You may also contact terms@fx-scape.com to request assistance or ask us to stop messaging.
We may send project communications, invoices, security notices and other non-promotional service messages where appropriate. Promotional emails will include an applicable unsubscribe method, and we will honor opt-out requests as legally required. Opting out of marketing does not necessarily prevent essential contractual, billing, security or transaction-related communications. We do not treat an ordinary business inquiry as blanket authorization for unrelated promotional messages.
We retain information for as long as reasonably necessary for the purpose collected, taking into account the nature of the relationship, contract performance, reasonable support and security needs, recordkeeping obligations, applicable limitation periods, tax and accounting duties, and potential disputes. Different categories may have different retention periods. For example, active project and commercial records may be maintained throughout the relationship and for an appropriate post-completion period; financial records for applicable statutory and accounting periods; security logs for a shorter risk-based period; suppression records as necessary to respect opt-outs; and browser-only state until it expires or is deleted. Archived backups may persist temporarily under normal backup rotations.
Retention is assessed using these criteria for the relevant records and purposes; this Policy does not promise a single fixed retention period for every category. Upon a valid request, we will delete or deidentify eligible information unless retention is authorized or required by applicable law.
We use reasonable administrative, organizational, technical and physical safeguards appropriate to the information and our operations. Safeguards may include access controls, authentication, provider security functions, backups, security monitoring and incident-response procedures as implemented. No website, software, email service, data transmission or storage system can be guaranteed completely secure. We will investigate suspected incidents and provide notices to affected persons or regulators when legally required. Please do not email passwords, full payment-card details, government identification numbers or other highly sensitive information unless a secure channel is expressly provided.
You may contact FX:Scape to ask whether we hold personal information about you and request access, correction, deletion or information concerning our practices. We will review requests in light of applicable law, the identity and authority of the requester, available records, and lawful exceptions. We may ask for information reasonably needed to authenticate a request and protect another person's information, but will not require unnecessary sensitive details. If a request relates to data controlled by a separate client, we may direct you to that client or assist as appropriate under our agreement. We will explain material reasons for denial where required. Voluntary assistance does not itself represent that every statutory right applies to FX:Scape in every circumstance.
California's Consumer Privacy Act, as amended (CCPA), applies only when the legal criteria defining a covered business and the relevant processing are met. Whether FX:Scape is a covered business requires periodic evaluation; operating in California alone does not conclusively establish coverage. To the extent the CCPA applies, eligible California residents may have rights to know/access, correct, delete, opt out of sale or sharing, limit certain uses of sensitive personal information, and be free from unlawful discrimination or retaliation for exercising protected rights, subject to conditions and exceptions. Authorized agents may act on behalf of consumers where permitted, subject to reasonable verification. We will observe applicable response deadlines, notice-at-collection, appeal/review and opt-out requirements to the extent required by law.
Where applicable law requires category-specific disclosures, a lookback period, additional request methods, or other notices, we will provide the required information and procedures. The rights described here apply only where the relevant legal requirements are met; this Policy does not itself represent that FX:Scape meets every statutory coverage threshold.
Residents of other jurisdictions may have additional rights depending on the location, nature of processing, applicable jurisdictional thresholds and exemptions. Where relevant law applies, we will provide required notices, lawful grounds for processing, request procedures and remedies. We do not represent that the European Union General Data Protection Regulation or every state privacy statute applies merely because a person anywhere can access the website. If FX:Scape deliberately offers services to individuals in covered jurisdictions or monitors their behavior in ways triggering a specific law, this Policy and related procedures may need jurisdiction-specific provisions.
We do not intentionally solicit sensitive personal information through ordinary website forms or engineering calculators. Certain activities may involve information about workers, incidents, precise locations or other sensitive matters as necessary for contracted projects or operations. Such information should be minimized and appropriately protected. We do not represent that we use automated decision-making systems to make legally significant decisions about individuals unless that activity is actually deployed and separately disclosed. Introducing biometric identification, employee monitoring, applicant scoring, AI-based profiling or materially similar activities may require additional notices, impact assessments and controls.
Our general website and professional services are directed toward adults and business users, not children under 13. We do not knowingly solicit personal information from children under 13 through the general website. If we discover such information was collected without an applicable lawful basis or parental authorization, we will take appropriate action, including deletion when required. Some public utilities might be accessible by minors incidentally; they are not designed as child-directed services. Do not rely on this statement if a new application is specifically marketed to children or students, as that would require separate legal and product assessment.
Links, videos, maps, payment forms, social services and other third-party integrations may have independent privacy practices. We do not control those third parties' policies. Where embedded services set cookies or transmit visitor information, we must accurately describe their presence and provide legally required choices. Consult the third party's notice for its independent processing.
In a potential or completed merger, acquisition, reorganization, financing, or disposition of assets, appropriate records may be reviewed or transferred subject to confidentiality and applicable law. We may preserve information relevant to litigation, legal holds, security investigations, regulatory matters, or enforcement of contracts for the time reasonably necessary. Such retention may continue notwithstanding an ordinary deletion request where a lawful exception applies.
We may update this Policy when our practices, vendors, features or legal requirements change. The posted policy will carry its current effective and last-updated dates. Material changes will be communicated at or before implementation where required by law, and we will obtain consent where required. This Policy is a notice of practices and rights; continued browsing should not be described as a blanket waiver of legal privacy protections. Prior versions should be retained for compliance and audit purposes.
